Supreme Court dismisses Peter Obi’s appeal, Tinubu wins

The Supreme Court has dismissed the appeal filed by the Labour Party (LP) presidential candidate, Mr Peter Obi, for lacking merit.

The apex court said that the appeal lacks merit.

The presiding judge, Justice John Okoro stated that the only difference between the appeals of Obi and the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, was the issue of double nomination of Vice President Kashim Shettima.

The court held that the issue had been determined in favour of Shettima.

Subsequently, the court upheld the election of President Bola Tinubu.

Justice Okoro had dismissed the appeal filed by the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, for lacking merit.

The court held that Atiku failed to prove that he won the election, stating that there was no alternative figure of votes to counter that validly declared by the Independent National Electoral Commission (INEC).

Tinubu survives as Supreme Court dismisses Atiku’s appeal

The Supreme Court said it can’t manufacture votes in support of Atiku and PDP.

The apex court dismissed all the grounds of appeal of Atiku and PDP on qualification, non-compliance with the Electoral Act, the 25% votes in FCT, and electoral malpractices.

Justice Okoro stated that since all the seven issues have been resolved against Atiku and PDP, the election of President Tinubu is affirmed.

The Supreme Court declared that the failure of IREV is not a ground for the nullification of presidential election.

Reading the judgement, Justice Okoro also declared that none securing of 25% of votes cast in the Federal Capital Territory (FCT) Abuja is not a basis for a candidate not to have been declared winner of the presidential election.
